The learned counsel for the appellant filed a memo seeking permission to withdraw the appeal on the ground that the matter was adjusted outside the court.

          In the light of the memo, he appeal is dismissed as settled out of court. The statutory amount that was deposited by the appellant while preferring the appeal be refunded to the appellant under proper acknowledgement and identification. No costs.
