JUDGMENT
The facts of the complaint in brief is that the Opp.Party is a reputed person and he is posing himself to be an authority under Khadi Board and he can sanction loan amount under KVI loan scheme. On 15.07.2013 the complainant has paid Rs.10,000/- to the Opp.Party in presence of Surendra Behera and after the said amount the O.P is not seen in the field and also in his address. The complainant with the help of Surendra Behera traced out him at Gunupur and on being asked he has confessed his guilt and stated that he is no more an employee of Khadi Board and he could not arrange the loan as promised by him and made such confession and promised to pay back the entire money within in 15.06.2015. The matter was also enquired by the Khadi board and they denied the existence of such a person in their establishment. Hence prayed to direct the O.p to pay back the entire amount and award monetary compensation for the mental agony and award cost of litigation and such the relief as the forum deem fit and proper. Hence, this complaint.
Being noticed by this forum the opposite party remained silent and did not turn of to file any written version and in absence of any written version from the opposite party we proceeded the matter exparte and believed the allegations of the complainant and hence, we passed the order and dispose of the matter with the following directions.
ORDER
The opposite party is directed to refund the deposited amount of Rs.10,000/- with 9% interest along with compensation of Rs.2,000/- for mental agony undergone by the complainant and cost of Rs.500/- to the complainant within one month from the date of receipt of this order, failing which the O.P is liable to pay interest @ 12% p.a. on the above awarded amount till the date of payment.
Pronounced in open forum today on this 22nd day of June,2016 under the seal and signature of this forum.
