JUDGEMENT

The  curx of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps    to receive  E.M.I from the complainant  inter alia release the Diesel  Car  bearing vehicle Regd. No. OD-14-6644 in favour of the complainant  for which  the complainant  sought for redressal of the grievances raised by the complainant.

The complainant had filed petition U/S-12 of the C.P. act inter alia filed  interim petition  U/S- 13-3-B of the C.P. Act.

This forum had passed exparte  interim order against the O.Ps on Dt. 20.01.2015   directed  the O.Ps  handed over  Diesel Car  Vehicle  bearing   No.OD-14-6644  to the complainant  interalia to receive the E.M.I. from the complainant.

Aggrieved the  above  exparte interim order the  O.Ps had preferred appeal before the Hon’ble State C.D.R.Commission, Cuttack   bearing  Revision petition No. 28 of 2015. The Hon’ble State C.D.R.Commission, Cuttack   on Dt. 28.08.2015  had passed order  that the O.P. shall pay the current E.M.I from December,2015. He shall also pay Rs.6,240/- on each months starting from December,2015 till contract period is over towards arrear installments. The  O.P. shall release the vehicle bearing No. OD-146644 within  5( five days) hence subject to payment of Rs. 1,70,000/- to the petitioner. Accordingly the revision petition is disposed of inter alia order  of the District forum is set aside.

Basing on the above judgement passed by the Hon’ble State C.D.R.Commission, Cuttack this forum disposed of the C.C. case No.21 /2015 accordingly. No cost and compensation.
