            To-day is fixed for payment of the amount of Rs. 85,000/-. Both parties are present. In compliance with Order No. 04. Dt. 28.03.2007 the O.P.s have filed one cheque bearing number 390567 dt. 16.04.2007 amounting to Rs. 57,000/- and one Cheque number CSC A/3 162144 dt. 11.11.2006 amounting to Rs. 28,000/- lying with an application which is put up to-day for order. It appears that Smt. Sandhya Das, the petitioner has filed an application expressing her inclination to receive both the cheques referred to hereinabove and with further prayer to dispose of the case, she is not inclined to proceed with this case.
 
            Perused both the cheques. Hd. petitioner herself. Perused the petition as well.
 
            In view of above there appears no impediment to allow the application of the petitioner as the same seems to be legally valid and sufficient.

Hence,                                                Ordered
 
that Malda D.F. Case No. 10/2007 stands dismissed on the ground of non-prosecution. Petition of the petitioner herself do form part of the order.
 
            The petitioner is at liberty to receive both the cheque nos. 390567 for Rs. 57,000/- and cheque no. 162144 of Rs. 28,000/- on proper receipt.
 
            Let a copy of this order be given to both the parties free of cost.
