Appellant through Mr. Prabir Basu, the Ld. Advocate and Respondent No. 1 through Mrs. Sampa Sengupta, the Ld. Advocate are present.In course of hearing of the appeal parties entered into a settlement.In terms of the said settlement possession of the disputed flat has been handed over to the Respondent No. 1 on 01.12.2009 which is admitted by the Respondent No. 1 also.Mr. Basu for the Appellant has also handed over the Bank Draft for a sum of Rs. 6,50,000/- bearing No. 058604 dated 01.12.2009 drawn on HDFC Bank to Mrs. Sengupta, the Ld. Advocate for the Respondent No. 1 in full and final satisfaction of the claim as regards compensation.Mr. Basu, the Ld. Advocate for the Appellant also informs that the defects identified in the flat will be removed within a period of one month to which Mrs. Sengupta indicates her client’s consent.As regards execution and registration of the flat, parties have agreed that the Appellant will complete execution and registration of Deed of Conveyance in respect of the disputed flat in favour of the Respondent No. 1 within two months from today.Mr. Basu also indicates that the Appellant has agreed to furnish Completion Certificate along with the modified sanctioned plan to the Respondent No. 1 within a period of the said period of two months.There being no other dispute indicated the appeal stands disposed of on settlement as indicated hereinabove.No order as to cost.
