Heard Mr. P. Mukharjee, learned counsel appearing for the petitioner in the Misc case for condonation and Mr. A.K.Sarma, learned counsel appearing on behalf of the respondent.

                  This petitioner is filed for condonation of delay of 49 days in filing the connected appeal. An affidavit has also been filed by the opposite party/respondent opposing the prayer for condonation of delay. We have gone through the grounds  stated in the condonation petition as well as the objection  filed by the opposite party/respondent  and we are satisfied  that the petitioner  was prevented from filling  the appeal in time. Accordingly, the delay of 49 days is hereby condoned.

                 Misc case stands disposed.

               In view of the order passed in the Misc case, Registry shall  allot a number to the pending appeal and the same shall be listed for admission on 19-7-2012.
