ORDER | No. 6/02.05.2011. Appellant through Mr. Barun Prasad, the Ld. Advocate and Respondent No. 1 through Mr. Swarajit Dey, the Ld. Advocate are present. Today is fixed for payment to the tune of Rs.10,000/- to each of the Respondents as per order dated 11.03.2011. It is evident from the record that today is also fixed for payment as a last chance. The Ld. Advocate for the Appellant Mr. Barun Prasad submits that talk of settlement is going on between the parties out of Court. But Ld. Advocate for the Respondent No. 1 raised vehement objection against such submission and submits that no such talk of settlement is going on. As the condonation petition was allowed subject to payment of cost of Rs.10,000/- to each of the Respondents and Appellant took several adjournments for such payment and today also prays for adjourment, but we are not inclined to grant further time and accordingly the petition for condonation of delay is hereby dismissed and the appeal is also dismissed being barred by limitation. | |
