| Final Order / Judgement | Sri Shyamal Gupta, Member Present Revision is directed against the Order dated 14-03-2016, passed by the Ld. District Forum, Kolkata-I (North) in CC/307/2015. By such order, the Ld. District Forum fixed the case for ex parte proceedings against the Revisionist. The case of the Revisionist, in short, is that, owing to non-receipt of vakalatnama and WV by post from its H.O. in Gurgaon, the same could not be submitted before the Ld. District Forum on the date fixed. Accordingly, it prayed for setting aside the impugned order. It is curious to note that the Revisionist has not adduced any documentary proof to substantiate the bona fide of its claim as mentioned hereinabove. In any case, in the interest of natural justice, we allow this Revision with a token cost. Hence, O R D E R E D The Revision stands allowed on contest against the Respondents/Complainants. The impugned order is set aside subject to payment of a cost of Rs. 5,000/- by the Revisionist to the Respondents/Complainants. Parties to appear before the Ld. District Forum on 03-07-2019 for payment of cost and submission of WV. | |
