Final Order / Judgement

                                         Heard Mr. S. Bhuyan, learned counsel, appearing for the applicant. Also heard Mr. K. K. Bhatta, learned counsel, appearing for the respondent No. 4.

                                           This is an application under Order 1 Rule 10(2) of the Code of Civil Procedure 1908 read with Section 151 of the said Code for striking out the name of respondent/opposite party Nos. 3 and 5 from the delay petition as wel as main appeal.

                                           Upon perusal of the statements made in the petition and after hearing the learned counsel appearing for the parties, prayer as made for is allowed.

                                           Office to correct the cause title accordingly.

                                           Misc Case is allowed and disposed of.
