The Ld. Advocate for the opposite party/revisionist is present. The revisional application dated 17.03.2023 u/s 40 of the Consumer Protection Act, 2019 is taken up for hearing.

Heard the Ld. Advocate for the opposite party/revisionist.

The Ld. Advocate for  the opposite party/revisionist submits that the Complaint case being no. CC/344/2021 was withdrawn by the complainant /respondent vide order no. 8 dated 17.02.2023 since his claim was satisfied. The date of the original deed is mentioned as ‘18.12.2019’ instead of ‘03.05.2011’in the said order no. 8 dated 17.02.2023 in CC/344/2021. Therefore, the same is required to be corrected.

Peused and considered the record of CC/344/2021.

I do not find any copy of deed  in the record of CC/344/2021.

In absence of the original deed or its copy, the date mentioned in the order no. 8 dated 17.02.2023 in respect of the date cannot be rectified. It appears from order no. 8 dated 17.02.2023 of CC/344/2021 that the documents filed by the opposite parties on that day were handed over to the complainant in presence of the Commission including the deed.

Having regard to the discussion made above, the revisional application cannot be allowed in favour of the opposite party/revisionist.

 Hence, it is,

                 ordered

that the revisional application be and the same is dismissed without cost.

Let a plain copy be given to the parties free of cost as per CPR.
