Final Order / Judgement

This case record has been placed before the ld. Judges of Upobhokta Lok Adalat which is held on this day at the court room of D.C.D.R.C., Hooghly.

Both sides and their ld. Lawyers are found present and ready.

Heard both sides and their ld. Lawyers. Considered submission.

In course of hearing it is revealed that the complainant agreed to pay Rs. 2,14,555/- by way of cheque being no. 759784 dt. 27.1.2024 of Rishra Post Office and the said cheque has been received by the op no. 2. It is also agreed by the parties that op no. 2 shall execute and register the deed of conveyance in respect of the suit property on behalf of all the ops after the encashment of the cheque and the said execution and registration of the deed of conveyance would be completed within 15 days from the date of encashment. The complainant agreed in this proposal.

As the parties agreed to settled the disputes involved in this case in the light of the submission highlighted by both sides and their ld. Lawyers, this District Commission has no reason to stand on the way of settlement.

In the result, it is accordingly,

ordered

that the C.C. case no. 38 of 2021 be and the same is disposed of as it is settled ion between the parties.

It is decided that the complainant shall pay Rs. 2,14,555/- to the op no. 2 by way of cheque being no. 759784 dt. 27.1.2024 of Rishra Post Office and after encashment of the cheque the op no. 2 shall execute and register the deed of conveyance in respect of the suit property which has been depicted in the schedule of the complaint petition within 15 days from the date of encashment of the cheque.

The above noted cheque is also handed over to the op no. 2 who received the same and filed receipt copy.

The complainant undertakes to bear the registration cost and also to pay the stamp duty.

The op no. 2 is also directed to issue the possession letter prior to the registration work.

Otherwise the complainant is given liberty to execute this award through law.

Let a free certified copy of this order be handed over to the parties immediately.
