ORDER

By Smt. Padmini Sudheesh, President: The petitioner’s case is as follows:- 1. The petitioner joined a kuri for a sala of Rs.25,000/- with 50 instalments at the rate of Rs.500/- per instalment started in November 1997 as per pass book No.S2/24. The period of kuri was over on 3.12.01. The entire kuri amount is paid by the petitioner. The respondents are the partners of Sreekrishna Bankers. At the time of joining the kuri, the respondents assured that after the duration period the entire kuri amount will be repaid within 30 days of the last instalment. The duration of the kuri transaction completed on 3.12.01. But the amount is not yet returned. Hence this petition. 2. The respondents are called absent and set exparte. 3. To prove the case of the petitioner he has filed affidavit and five documents. The documents are marked as Ext. P1 to P5. 4. Heard the Counsel. 5. According to the petitioner, he is entitled to get back Rs.22,500/- with interest and costs. There is no counter evidence. 6. So the petition is allowed and the respondents are directed to pay Rs.22,500/- (Rupees twenty two thousand and five hundred only) with interest at the rate of 12% per annum from 3.12.01 and 6% interest from today till realization and cost of Rs.1500/- (Rupees one thousand and five hundred only) to the petitioner. Time for compliance one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 13th day of May 2008.
