By Smt. Padmini Sudheesh, President:

This complaint is filed to get back the amount remitted in the kuri conducted by the respondent. The case is as follows. The complainant joined in the kuri conducted by the respondent on 29.12.05 as per statement No.27. The kuri completed on 14.8.07. The complainant promptly paid all the instalments. Accordingly he has remitted Rs.30,000/- in the kuri. Even though the kuri has completed, the respondents have not repaid the kuri amount. Thus the complaint filed.

            2. The respondent called absent and declared exparte.

            3. The complainant has filed affidavit and produced the kuri passbook and is marked as Ext. P1.

            4. The complainant’s case is that complainant has joined a kuri conducted by the respondents and promptly remitted all the instalments. He has already paid Rs.30,000/- in the kuri. Even after the termination of the kuri the amount has not been returned to him. The Ext. P1 passbook clearly proves the remittance and the complainant is entitled to get back the amount remitted in the kuri with interest.

            5. There is no evidence to the contrary.

            6. In the result, the complaint is allowed and the respondent is directed to return Rs.30,000/- (Rupees thirty thousand only) to the complainant with interest at the rate of 12% per annum from 14.8.07 till realization with cost Rs.1000/- (Rupees one thousand only) within two months
