Brief facts of the complaint:-

Complainants are the legal heirs of deceased A.V.Mathew who has joined in a Kuri conducted by the opposite parties.  An amount of Rs.1 lakh was paid towards the Chitty and thereafter amount could not be paid since the opposite party company has been closed.  Hence complainants claiming the amount paid along with interest, cost & compensation.       

Opposite party filed a statement stating as per Section 446 of the Companies Act, No Court can proceed against the company when a winding up order has been passed and official liquidator appointed.  Judgment of Hon’ble  High Court also produced.

Both parties heard regarding the preliminary issue.  As per the order of the Hon’ble High Court, it is seen that the opposite party company has been wind up and official liquidator has been appointed.  In view of the said circumstances, the complainant has to approach the official liquidator for relief.  Hence complaint dismissed with direction to approach the official liquidator for relief.
