This is a complaint filed under Section 35 of the Consumer Protection Act, 2019.
- The case of the complainant, in brief, is as follows:
On 01/09/2023 the complainant sent a GPS device for service to the company through the courier service of the opposite party. It was assured by the opposite party that the courier would be delivered on 04/09/2023. But it was not delivered till 07/09/2023. So he asked the opposite party to return the courier. It was delivered only on 22/09/2023. He was put to gross hardship and inconvenience due to the negligence and latches of the opposite party. Hence the complaint claiming compensation to the tune of Rs. 2 lakh from the opposite party.
- The notice issued from this Commission was duly served on the opposite party. But the opposite party did not respond to the notice and hence set exparte.
- The points that arise for determination in this complaint are;
1) Whether there was any deficiency of service on the part of the opposite party, as alleged?
2) Reliefs and costs.
- The complainant was examined as PW1 and Exts. A1 to A4 were marked.
- Heard.
- Point No.1: The complainant has approached this Commission alleging deficiency of service on the part of the opposite party in delivering the parcel which was sent through courier.
- PW1 has filed proof affidavit in terms of the averments in the complaint and in support of the claim. Ext A1 is the call logs, Ext A2 is the copy of the tracking details, Ext A3 is the copy of the cash memo dated 01/09/2023 and Ext A4 is the customer reviews.
- The evidence of PW1 stands unchallenged. The opposite party has not turned up to file version. The opposite party has not produced any evidence to disprove the averments in the complaint or to rebut the veracity of the documents produced and marked on the side of the complainant. There is no contra evidence to disprove the claim of the complainant. The complainant’s case stands proved through the testimony of PW1 and Exts A1 to A4. Deficiency of service on the part of the opposite party stands proved. The complainant was put to mental agony and inconvenience due to the indifference and deficiency of service on the part of the opposite party. The complainant is entitled to be compensated adequately. Considering the entire facts and circumstances, we are of the view that a sum of Rs. 10,000/- will be reasonable compensation in this case.
- Point No. 2 : In the light of the finding on the above point, the complaint is disposed of as follows:
- CC 494/2023 is allowed in part.
- The opposite party is hereby directed to pay a sum of Rs. 10,000/- (Rupees ten thousand only) as compensation to the complainant.
- The payment as afore stated shall be made within 30 days of the receipt of copy of this order, failing which, the amount of Rs. 10,000/- shall carry an interest of 6% per annum from the date of this order till actual payment.
- No order as to costs.
