Final Order / Judgement

 

The Petitioner is present on call. The case is posted today for hearing on the petition for interim order.

The case of the petitioner/Complainant is that he is an policy holder of RPLI bearing Policy No-R-OR-BF-EA-21814 and the said policy has already been matured on 28th January, 2015. On its maturity the competent authority, the senior superintendent of post Office, Jeypore, Koraput (OP No-1) sanctioned for payment vide his sanctioned letter no. Maturity/KPT-163/R-OR-BF-EA-21814/ (Key-id 159088) dated 5.03.2015 for Rs. 90,924/- payable to the complainant through the Post Master, Jeypore H.O and SPM, Khiraput S.O. Accordingly the Senior Superintend of Post Offices (OP No-1) communicated the said sanctioned letter to the Post Master, Jeypore H.O (OP No-2) along with copy of the same endorsed to the complainant. On receipt of the sanctioned letter from the OP No-1, the complainant contacted the OP No-3 towards the payment of the maturity/sanctioned amount several times but the Opposite Party No-3 said that he has not received any direction from the OP No-2 for payment of maturity amount of RPLI in question. Despite sending his complain to the OP No-1&2 on the question of non-payment of sanctioned amount of RPLI, the Opposite Party No-3 mis-behaved the complainant in an unfaruman manner and threatens the complainant to book in a case if he again visit to the Post Office in order to ask for payment of the said amount. It is submitted that the mother of the complainant is aged about 95 years and she is bed ridden since December, 2014 for sickness and due to want of money the complainant could not treat her mother properly elsewhere. The petitioner further submitted that taking the plea of the pending complain case, the Opposite Parties may linger to pay the maturity amount of the RPLI and thereby he may not treat his mother for the want of moneypending adjudication of original complain case he prayed for release of maturity amount of Rs. 90,914/- bearing RPLI Policy No-R-OR-BF-EA-21814.

Heard the petition at length and perused the complaint petition along with documents available in the record carefully and found that the Opposite Party No-1 the SSPO, Jeypore, Koraput has sanctioned the maturity amount id the RPLI Policy No. R-OR-BF-EA-21814 vide his sanctioned letter No. Maturity/KPT-163/R-OR-BF-EA-21814/ (Key-id 159088) dated 5.03.2015 for Rs. 90,924/- in favour of the complainant payable through the Post Master, Jeypore H.O and SPM, Khairaput. Though more than one and half months have already been elapsed, the Opposite Party No-2&3 has not paid the maturity amount of the policy to the complainant. In the above facts and circumstances of the petitioner in exercise of our jurisdiction U/S 13 (3B) of Consumer Protection Act, 1986. Hence, we are inclined to pass the following order.

Pending adjudication of the original Complaint case No. 43/2015, the Opposite Parties No-1 & 2 are directed to examine the case of the complainant and if, the case of the petitioner is a bonafide one then, pass necessary direction to the Opposite Party No-3 to pay the maturity amount of the RPLI to the complainant within three days from the date of receipt of a copy of this order and report the compliance of the order on 7th May, 2015 at once.

Let a copy of this order be communicated to the Parties at once.

Put up on 7th May, 2015 for further order.
