          Office report seen. Arguments heard on the admissibility of the complaint. Complainant has filed the instant complaint under section 12 and 13 of the Consumer Protection Act, which is supported by an affidavit and various documents alleging deficiency in service on the part of the Opposite Parties.  As per the version of the complainant, he is a ‘consumer’ of Punjab State Power Corporation Limited and electricity tubewell connection bearing account No.AP19/701Y is installed in Khatauni No.59/1, khasra No. 30//13 (8-0) in the name of complainant in village:  Khara. The complainant is using the electricity and beneficiary of the services of the Opposite Parties. The connection was installed in the year of 2009 and the entries regarding the same from 1962 to 1996 clearly shows in the pass book issued by the Opposite Parties It is averred that due to the mistake of the Halqa Patwari, the farad of another land of the complainant was issued and submitted with the Opposite Parties  of the land bearing khasra No. 39//12/1-11/2. It is further pleaded that connection has been rightly installed in khasra No. 30/13(8-0). Later on the Opposite Parties  demanded farad of khasra No. 30//13 (8-0) which was submitted  by the complainant to the Opposite Parties  on 10.09.2012. It was alleged that in the month of January, 2013 the above said tubewell connection of the complainant was got disconnected i.e. after 6 years of its installation on the ground  that the wrong farad was submitted by him. It was pleaded that the land in both the farads was under the ownership and possession of the complainant. It was alleged that connection was not restored despite request of the complainant.  However, Chief Engineer of Enforcement Amritsar conducted an enquiry on the matter and in his order dated 21.10.2013 has recommended for restoration/ reinstatement of the electricity connection. It was pleaded that the tubewell connection is an old one, which is to be restored.         

          From the perusal of the complaint as well as documents, we do not find that the complainant is a ‘consumer’  of the Opposite Parties. When he is no longer consumer, then the question of deficiency of service on the part of the Opposite Parties does not arise. Perusal of the file further reveals that complicated questions of law and facts are there which can not be decided by this Fora in summary manner. The complaint is not fit to be admitted and to proceed further. The complaint is accordingly returned to the complainant with liberty to seek appropriate relief in the civil courts, if so permissible or advised in accordance with law. Original documents, if any, be returned to the complainant. However, the photo copies of the documents be retained for record. File be consigned to record room.
