The instant complaint is filed by Kulwant Kaur wherein alleged that husband of complainant was serving as Inspector under opposite party no.1 and 2 and retired from department of opposite party no.1 and 2 in 2011. Complainant fell ill on 13.7.2016 and remained admitted at Surjit Hospital, Kalanaur till 19.7.2016 and her husband spent an amount of Rs.26,550/- on her treatment and after that she approached the opposite parties many times for the reimbursement of the medical bills but opposite parties are lingering on the matter on one pretext or the other and the complainant is forced to file the present complaint with a prayer to reimbursement of medical bill of Rs.26,550/- with interest @ 24% alongwith compensation and litigation expenses.
2. We have heard the counsel for the complainant on the question of admission of instant complaint and also perused the file. After going through the contents of complaint, we find that complainant has not described anywhere in the complaint how she is consumer of opposite parties and what kind of services were agreed to be provided by the opposite parties to the complainant. The basic dispute in this complaint is only that a medi-claim bill had been submitted by the complainant for her treatment from Surjit Hospital, Kalanaur and medical bill Rs.26,550/- is still pending with opposite party for reimbursement.
3. We find that medical bill claim is a facility given by the Government to its employees as well as pensioners and it is not a service provided by the Government. So we come to the conclusion that complainant is not the consumer of the opposite parties and therefore, instant complaint is not maintainable. However, the complainant is at liberty to adopt the appropriate remedy from any competent court/Forum for getting the relief in question. In view of it, the present complaint is dismissed.
4. Copies of the orders be furnished to the parties free of costs. File is ordered to be consigned to the record room.
