Today is fixed for admission hearing of this complaint. During admission hearing it is noticed by us that though the complaint is filed by Sabita Jana, but the Affidavit is filed by Shri Joyhari Jana and in the said affidavit signature has been put by Shri Joyhari Jana, which is not at all legally permissible. As per settled law affidavit should be filed and signed by the person who files the complaint.

Therefore on the abovementioned score the Consumer Complaint being no-CC/49/2021 is thus dismissed without being admitted. There is no order as to cost. The Complainant is at liberty to file afresh after rectification of the said error before the competent Commission/Court, if not barred otherwise.
