Final Order / Judgement

The record is put today on the strength of the Plain copy (free of cost) received from Hon’ble State Consumer Disputes Redressal Commission, W.B.

This Execution Application has been arisen out CC/09/2013 which was disposed of on 17.01.2014 being allowed on contest as against the OP no.3 i.e. Senior Divisional Manager, New India Assurance Co. Ltd, 4, Mango Lane (2nd floor), Kolkata: 700001 and be dismissed as against the OP Nos. 1 & 2 without any order as to cost. The OP no.3 mentioned above is hereby directed to pay a sum of Rs.1, 00,000/- to the complainant within two months from the date of this order failing which an interest @ 9% p.a will carry upon the awarded amount from the date of filing of this case i.e. 29.04.2008 till final payment.

The D.hr has filed this Execution Application on 26.02.2013 as the Jdr. did not comply the aforesaid order.

The case has been fixed for awaiting order from the Hon’ble State Consumer Disputes Redressal Commission, W.B. vide FA No. 98 of 2013 since 05.08.2013. The D.hr. is found absent since 19.06.2015. The Jdr has been filing only haziras.  

The Hon’ble State Consumer Disputes Redressal Commission, W.B. has passed the order in that appeal on 04.04.2014 as under:-

‘M.A. No. 84/2014 is moved by the Ld. Advocate for the Appellant who submits that in view of the appeal being allowed by this Commission, the statutory deposit may be refunded to the Appellant. Prayer stands allowed. Office is to act accordingly. M.A. is thus disposed of.

As per above order of the Hon’ble State Consumer Disputes Redressal Commission, W.B., the execution case be disposed of accordingly.

Hence,

                                                   Ordered

that the Execution Application No. 04/2013 be and the same is hereby disposed of as per order dated 04.04.2014 of the of the Hon’ble State Consumer Disputes Redressal Commission, W.B.

Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post  to the concerned parties as per rules, for information and necessary action.
