The Complainant files hazira through advocate.
No step is taken by the O.P.
O.P. is found absent on repeated call.
The case is fixed for ex-parte hearing.
The Complainant’s case is that he took cash credit loan for Rs.5 Lakh in the month of June, 2014 vide A/c No.1295008700001610 in the name of M/s. Tarama Distributors of which Complainant is the Proprietor for his business purpose but he defaulted in repayment of the loan and accordingly Demand Notice was sent to the Complainant on 09/07/2018 and 02/08/2018 with the request to pay the outstanding dues of Rs.2,93,791/-with interest by availing One Time settlement scheme. The Complainant took another Vehicle loan A/c No.201900NG00018663 in the name of the Complainant but the said A/c was closed on repayment of the entire loan amount and No Dues Certificate has been issued by the O.P./Bank. The Complainant has approached this Commission challenging the said Demand Notice on the ground that No dues Certificate has been issued by the O.P./Bank Authority.
O.P./Bank though appeared in this case but preferred not to contest the case by filing any written version.

The Commission has examined the Complainant’s case and the materials on record and also heard the Ld. Advocate for the Complainant who tried to impress upon the Commission at the time of hearing that No Dues Certificate issued by the Bank Authority relates to the aforesaid Loan A/c for business purpose. But on perusal of all the relevant documents the Commission finds that the Complainant has availed of two loan A/cs one for purchase of Vehicle Loan A/c No. No.201900NG00018663 standing in the name of the Complainant himself and No Dues Certificate has been issued by the Bank Authority in respect of that Loan A/c. But for other Business Loan A/c No. 1295008700001610 in the name of M/s. Tarama Distributors of which Complainant is the Proprietor there is an outstanding dues of Rs.2,93,791/- and the said Loan A/c has become NPA and ultimately the O.P./Bank Authority served the Demand Notice in connection with that Loan A/c and the Complainant could not produce any No Dues Certificate in respect of that business Loan A/c. The Complainant has confused his case by mis-statement made in the petition of complaint.
Accordingly the case is dismissed ex-parte against the O.P. without any merit.
Both parties be supplied copy of this order free of cost.
