Complaint under section-12 of Consumer Protection Act, 1986

Now  amended  Section 34 of Consumer protection Act 2019.

                             Sh. Vijay Kumar A.R on behalf of opposite parties Nos.1 & 2.

 

ORDER:   

 

                             Today the case was fixed for arguments.

2.                          Instead of arguing the case, Shri Manoj Kumar Gupta, counsel for the complainant has made a statement that “Refund of the ticket amount has been received by the complainants already. I only press for the harassment, litigation charges and extra charges paid for hotel and travel by the complaints.    

 

3.                          On the basis of the statement of ShriManoj Kumar, counsel for the complainant, the Commission is of the opinion that after filing of the complaint, opposite party has made payment to the complainant.  Opposite party has harassed the complainant mentally.  Hence, opposite parties are negligent on their part.  Deficiency of service is proved. . Hence the complaint is disposed off with the direction to opposite parties to pay lump-sump of  Rs.7000/- to the complainant within 30 days from the date of receipt of copy of this order.  Copy of this order be sent to the parties concerned free of costs. File be consigned to the record room.
