The complaint has been filed by the complainant U/S 35 of Consumer Protection Act 2019 alleging deficiency in service on the part of the opposite party in cancelling the flight booked by the complainant without prayer intimation seeking direction to direct the opposite party to pay a sum of Rs.40,000/- towards compensation for financial loss due to deficiency in service and to pay a sum of Rs.25,000/- towards compensation for mental and to pay a sum of Rs.5,000/- towards cost of this proceedings.
No representation for the complainant. Inspite of sufficient opportunities given for complainant to file the proof affidavit in support of his case he did not come forward to file the same. Hence we are of the view that that there is no purpose in keeping the complaint on file. Hence the same is dismissed for non prosecution. No cost.
This order has pronounced by us in the open Commission on this 31st May 2022.
