The instant appeal has been filed by Hari Kishan Saini–complainant against the order dated October 21^st, 2016 passed by District Consumer Disputes Redressal Forum, Gurgaon (for short ‘District Forum’) whereby complaint was dismissed in default.

2.      Mr. Mangat Ram-Representative of appellant has urged that due to illness, appellant could not appear on the date fixed before District Forum and the complaint was dismissed in default. 

3.      Be that as it may, without delving deeper, this Commission deems it appropriate to restore the complaint.  The appeal is accepted and the impugned order is set-aside. The complaint is restored to the board of District Forum for adjudication.

4.       The parties are directed to appear before the District Forum on March 15^th, 2017.

5.      Copy of this order be sent to the District Forum.
