Final Order / Judgement

Today is fixed for admission hearing of this complaint. The Complainant is present in person. We have carefully perused the content of the petition of complaint. It is seen by us that the Complainant has sought for refund of the amount of Rs.2,50,000/- from the OP. On being asked the Complainant has replied that after making payment of the aforementioned amount the Insurance Company had already remitted the policy copy to him. But at this juncture the Complainant is inclined to get refund of the said amount from the OP-Broker.  The Complainant has failed to make out a case that there is deficiency in service on behalf of the OP-Broker

In the instant complaint we are to rely on the Ruling i.e. LICI vs. Surinder Kaur & Others (Civil Appeal no-5334/2006, SLP (c) no-7865-7866/2005), wherein Their Lordships have been pleased to hold that ‘jurisdiction of consumer fora can be invoked only in case where there has been a deficiency in service on the part of the insurer,’ In the case of Sagar Polymers vs. SBI the Hon’ble NCDRC has observed that the allegations of fraud and forgery the Applicant/Complainant should seek remedy from the Civil Court.

Therefore in view of the above we are not in a position to admit the Complaint and accordingly the Consumer Complaint being no. CC 36/2021 is dismissed without being admitted. There is no order as to costs.

Let plain copy be given to the parties free of cost as per CPR.
