1. This complaint is filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.
2. This is a complaint filed by the complainants against the opposite party alleging deficiency in service on the part of the opposite parties. After admitting the complaint, notice was issued to the opposite party. The opposite party entered appearance and filed written version denying the allegations raised by the complainants. As the complainants were continuously absent since 17/11/2021 to 02/06/2022 this commission issued a notice to both complainants to appear before this commission on 30/07/2022. On 30/07/2022 the complainants 1 & 2 appeared before this Commission and the case was posted to 30/09/2022 for filing proof affidavit of the complainant. Subsequently on 30/09/2022, 08/11/2022 and today the complainants were continuously absent and not filed affidavit before this Commission to further proceed with this complaint. In the above circumstances, we find that the complainants are not interested to further proceed with this complaint.
In the result, complaint is dismissed for default. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
