The complaint was filed by the complainant U/S 35 of the Consumer Protection Act 2019 alleging deficiency in service against the opposite parties in forcibly vacating the complainant from the room before 12 hours even though the complainant is entitled to stay for 24 hours along with a prayer to direct the opposite parties to pay a sum of Rs.5,00,000/- towards compensation for the mental agony and hardship caused to the complainant and to pay a sum of Rs.5,000/- towards cost of the proceedings to the complainant.
No representation for complainant. Proof affidavit not filed by the complainant. Sufficient opportunities given for filing Proof affidavit and for appearance on 06.09.2022, 26.09.2022, 13.10.2022, 26.10.2022, 15.11.2022, 24.11.2022, 30.12.2022 and 23.01.2023. In spite of the same, complainant failed to appear and prosecute the case. Hence, this commission is of the view that no purpose in keeping the complaint on file. Hence the consumer complaint is dismissed for non prosecution. No cost.
