JUDGMENT /FINAL ORDER

                Complainants above named filed this complaint against the aforesaid Opposite Parties praying for direction to remove penalty charges, compensation and other reliefs.

                She alleged that she took a loan from the Opposite Parties amounting to Rs. 3,50,000/- and out of the  said amount she already paid Rs. Rs. 3,66,000/-.

                In the pandemic situation she could not pay the loan amount. Opposite Parties started to impose unusual charges. Complainant suspects that O.P charged some other amount without her consent. She submitted one application before the O.P and prayed for calculation sheet and also prayed for consideration of aforesaid fact but she did not get any fruitful result. Hence, the Complainant filed this case.

               

Decisions with Reasons:-     

                Case was admitted on 23/05/2022. Thereafter, 12/05/2023 was fixed for further argument. But on that date Complainant was absent without any steps. 

                Complainant was asked to file Show Cause by 03/08/2023 as to why necessary order shall not be passed against her vide order no. 09 dated 12/05/2023.

                But on the next date i.e. on 03/08/2023 Complainant did not file Show Cause. Even she did not take any steps on that date. Case was adjourned for the ends of justice and next date was fixed on 21/12/2023.

                But on 21/12/2023 and 02/05/2024 Complainant did not take any steps nor filed Show Cause.

                Even Complainant was found absent without any steps on 02/07/2024. She did not file Show Cause on 02/07/2024 as per order no. 09 dated 12/05/2023.

                The conduct of the Complainant indicates that she is not willing to proceed with this case. In this situation we have no other alternative but to dismiss the case.

In the result, present case fails.

That the present case be and the same vide no. CC/155/2022 is dismissed ex-parte against the Opposite Party but without any order as to costs.

Let a copy of this order be supplied to both the parties free of cost as per CPR, 2005.
