  1. In the instant case the Complainant has sought for following reliefs against the Opposite party:-
  1. To direct the opposite parties to restore the supply of energy in the said premises of the complainant.
  2. To direct the opposite parties to pay Rs. 50,000/- ( Rs. Fifty Thousand only ) as compensation.
  3. To direct the opposite parties to pay Rs. 10,000/- ( Rs. Ten Thousand only ) as litigation costs.
  1. The facts of this case lies in a narrow compass which is as follows:-

It is the case of the complainant that he is residing with his family in the building situated at Bihar Vidyapeeth, P.O. Sadakat Ashram, near Kurji holy Family Hospital, Patna. The complainant submitted appropriate application before the concerned authority to provide new connection of electricity in the aforesaid building and for which he has also deposited security money etc. as per direction of appropriate authority. The supply of electricity connection was provided to him with regular supply of electricity. Vide annexure – 1 and 2 the complainant has deposited the amount of bill provided by the opposite party no. 1.

It is further case of the complainant that suddenly the electricity to the aforesaid building was disconnected on 03.02.2014 without following the provision mentioned in Electricity Act i.e. without giving any notice etc. in this regard. Thereafter, the complainant approached opposite party no. 2 i.e. Electrical Executive Engineer, electric supply division, Patliputra Division, Patna and requested to restore the supply of electricity but his sprayer was refused while the similar prayer of Ramakant Rai and Prakshin Thakur has been allowed and their electric connection has been restored.

The complainant has asserted that he is ready to pay any dues/arrear etc. if any subject to restoration of his electric supply by opposite party no. 2.

On behalf of complainant an interim application has also been filed for similar relief as the matter is urgent.

At the time of hearing this complaint petition, the learned counsel for the complainant has submitted that the complainant is ready to deposit any bonafied dues or arrear if any subject to the condition that electric connection may be restored immediately.

Heard the learned counsel for the complainant.

This complaint petition was admitted on 03.03.2016 but as the complainant wants simple direction for restoration of electric connection subject to payment of all dues by the complainant hence we think it proper to pass appropriate order at this stage.

The facts asserted by the complainant has been narrated briefly in forgoing paragraphs.

In the facts and circumstances of the case mentioned above, we direct the complainant to approach opposite party no. 2 with an application for restoring the electric connection with the certified copy of this order.

If the complainant files the aforesaid application with certified copy of this order then the opposite party no. 2 is directed to provide necessary bill to the complainant if any amount is dues and restore the electric connection subject to payment of all necessary dues in accordance with law.

The opposite party no. 2 must act within the period of 15 days from the date of filing of application by the complainant failing which opposite party will have to pay Rs. 50/- per day to the complainant till the electric connection is restored.

With the aforementioned direction this complaint petition stands disposed off.
