The complainant herein had purchased a mobile phone worth Rs.29,333/- on 14.1.14 by seeing the attractive publication of opposite parties. Thereafter the screen of the mobile phone was broken and it was replaced with new one. After one week, the replaced mobile phone was got damaged. The complainant approached the opposite party No.2 for the replacement of the mobile phone. But they were not ready for the same. Thereafter the complainant had issued a registered lawyer notice to the opposite party No.1, for which they had not replied. The complainant alleges deficiency in service upon the opposite parties and hence this complaint.
The opposite party No.2 was set exparte on 4.4.15. The opposite party No.1 was appeared on the same day and though ample opportunities were given, no versions was filed and they set exaprte on 27/11/15.
The complainant filed Cheif Affidavit and Ext. A1 to A3 were marked. Since there was no contra evidence, the case of the complainant has been prooved.
Heard the counsel for the complainant, perused the records and we feel that the complaint is a genuine one and so we are passing the following orders.
1) The opposite parties 1 and 2 shall jointly and severally remit Rs. 29,333/- being the value of the mobile phone to the complainant along with a compensation of Rs.10000/- and a cost of Rs.4000/- failing which they shall further pay 6% interest upon the above amount from the date of pronouncement of this order.
This order shall be complied with in one month from the date of receipt of the copy of this order.
