AWARD

1]        Vide his separate statement recorded on 05.11.2024, the ld.Counsel for the OP stated that the matter has been settled amicably and as per settlement, the OP Company made offer to refund the invoice amount of Rs.53,700/- of the appliance (LED T.V.) in question to AV Industries, subject to return of the appliance along with its accessories, if any, within 3 week from 05.11.2024 and this will be towards full & final settlement of the dispute in the present consumer complaint. The payment shall be made in the account of AV Industries having Account No.01078130000094, IFSC Code : HDFC0001417, HDFC Bank, Industrial Area, Phase-II, Chandigarh.

2]        Sh.Avinash Gupta, Proprietor of AV Industries, Plot NO.756, Phase-2, Industrial Area Phase-2, Chandigarh and Sh.Dinesh Kumar Gupta, Complainant in person, also stated separately that they admit the aforesaid statement/offer of ld.Counsel for the OP and accept it and the Complaint be disposed of accordingly in upcoming Upbhokta Lok Adalat

3]        In view of the statements of the ld.Counsel for OP, Sh.Avinash Gupta, Proprietor of AV Industries and Sh.Dinesh Kumar Gupta, Complainant and in terms of the settlement, the complaint stands disposed of by passing the following award:-

1. The OP is directed to refund the invoice amount of Rs.53,700/- of the appliance (LED T.V.) to AV Industries having Account No.01078130000094, IFSC Code : HDFC0001417, HDFC Bank, Industrial Area, Phase-II, Chandigarh within 3 week w.e.f. 05.11.2024, failing which the OP shall pay the said amount of Rs.53,700/- to AV Industries along with interest @9% per annum from the date of default till the date of payment.
2. Sh.Avinash Gupta, Proprietor of AV Industries and Sh.Dinesh Kumar Gupta, Complainant are directed to return the appliance (TV in question) along with its accessories, if any, to the OP.

4]   The award is accordingly passed.

5]   Certified copies of this order be sent to the parties free of cost. The file be consigned.
