SRI.P.V.JAYARAJAN: PRESIDENT

This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite parties alleging deficiency in connection with the defect in the TV purchased from the opposite parties.  After admitting the complaint notice was issued to the opposite parties.  When the case came up for consideration on 26/05/2022, the complainant was absent and 2nd opposite party represented and submitted that the matter is settled.  The complainant was absent since 02/04/2022.  As the complainant was continuously absent and not available for confirming the settlement, we presume that the complainant is not interested to further proceed with this complaint.  As the complainant has not adduced any evidence, to prove her case against the opposite party coupled with the continuous absence of the complainant before this Commission, we find that this is a fit case to be dismissed.       

In the result the complaint is dismissed.  There will be no order as to cost.                  

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
