Brief facts of the present complaint are that he had purchased a refrigerator make Godrej, blue in colour, model No. GDN 180 P bearing serial no. 0009807 from OP no. 1 vide cash memo no. 8984 dated 16.05.2006. It is alleged that at the time of purchase of above refrigerator, OP no. 1 has given in writing a warranty card with his prescribed stamp that the above Godrej refrigerator comes with a unique 10 year rust protection plan. It is alleged that the said refrigerator got rusted on bottom of the door as well as inside the plat form for which I have complained so many times but to no avail. The complainant further alleged that due to the act and conduct of the Ops he has to suffer harassment, mental agony and humiliation etc. Hence, it amounts to deficiency in service on the part of OPs and as such, he has to file the present complaint & prayed for seeking compensation and replace the above refrigerator with new one.
2. OPs no. 1 to 3 have failed to come present. Hence they were proceeded against exparte vide order dated 12.05.2016.
3. We have heard the complainant in person and perused the record carefully.
4. Complainant in person reiterated the contents of the complaint. He referred the bill no. 8984 dated 16.05.2006 and warranty card. He submitted that the OP provided 10 year rust protection plan for the refrigerator which was purchased by him on 16.05.2006. He submitted that the refrigerator got rusted on bottom of the door etc.
5. The Ops did not bother to appear and contest the claim of the complainant. No rebuttal has been come on the file to the pleadings of the complainant on behalf of the Ops. Considering the pleadings and supported documents placed on the file by the complainant, we partly allow the complaint of the complainant and direct the Ops to pay Rs. 2,000/- as lump sum compensation to the complainant, jointly and severally. Certified copies of the order be sent to the parties free of costs. File be consigned to the record room, after due compliance.
