The Decree Holder files hajira. JDR No.3 files a petition along with certified copy of judgment passed in SC Case No. – FA/541/12, which was referred challenging the final order passed in Case No.   CC-20/2009, praying to reject this execution case stating that the final order under execution has been set aside by the Hon’ble State Commission, West Bengal by passing the judgment in the Appeal Case No. FA/541/12.

We carefully perused the certified copy of the final order of the Hon’ble State Commission and it appears that the Hon’ble State Commission has been pleased to set aside the final order passed in Case No. CC-20/2009 under execution and has been pleased to sent back said case for fresh adjudication on individual basis. So, it is clear that the final order of the CC Case under execution has no existence at present and accordingly this Execution Case has lost its force.

In the above circumstances the Execution Case is liable to be rejected.

Hence, it is

ORDERED,

that the Execution Application No. 16/2012 is disposed of on rejection.

Let the true copies of this order be supplied to the parties free of cost.
