Heard Mr. D. Das, learned counsel, appearing on behalf of the petitioner. This is an application filed for stay of execution notice issued by the District Forum, Darrang at Mangaldoi under section 27 of the Consumer Protection Act, 1986 which is available at Annexure –A.

            The petitioner has also filed an appeal along with an application for condonation of delay and this Commission has issued notice to the respondent in connection with condonation matter. During the pendency of the application for condonation of delay, the present Misc Case No. 42/2014 has been filed on the ground that the order under appeal is sought to be executed. We find that unless the execution notice is stayed all pending matters will be infructuous.

            Accordingly, it is ordered that there shall be no execution proceeding by the District Forum until further order.
