Heard Mr. T. Kalita, learned counsel, appearing for the applicant. Mr. Kalita has submitted that he has filed an application for striking out the name of respondent Nos. 3, 4 and 5 from the Misc Application No. 111/17 as well as accompanying appeal No. F.A. 55/17. Also heard Mr. M. Smith, learned counsel, appearing for the respondent No. 2.

        We have perused the statements made in the application. Mr. Smith has submitted that he has no objection against the application filed on behalf of the applicant/appellant for striking out the name of respondent Nos. 3,4 and 5.

        In view of the same, prayer so made is allowed.

        Misc Case is allowed and disposed of accordingly.
