This complaint is coming on this day for orders in the presence of Sri G.Naga Lakshmi Reddy, Advocate for complainant and Sri P.Siva Sudarshan, Advocate for opposite party No.1 and in person for opposite party No.2 and upon perusing the material papers on record, the Forum made the following.


 

                                              ORDER

                                         C.C. No.59/2011

 

1.     This case is filed by the complaint under section 11 and 12 of           C. P. Act, 1986 seeking a direction on opposite parties for the payment of :-

  1. Rs.2,500/- as fee reimbursement balance with 24% per annum interest from 01-07-2008 to 22-02-2011.

                            

  1. Rs.5,000/- for causing mental agony.

 

  1. Rs.10,000/- towards damages and intentional bad service.

 

  1. Rs.2,000/- as cost of the case.                                     

                                     

2.    The synopsis of the complainant Maheswari’s case is that she studied B.Sc. Computer applications (B.Sc. (C.A.)) 1st year and 2nd year during 2008-2009 and 2009-2010 respectively in opposite party No.1 College at Atmakur, Kurnool District. She paid Rs.500/- each at the time of admission in the 1st year and 2nd year.  She belongs to vadde community and is entitled for fee reimbursement (RTF) to be sanctioned by Government of Andhra Pradesh.  Opposite party No.1 also gave assurance on the RTF at the time of giving admission to her.  In the beginning of 3rd year she got married and wanted to take admission on transfer in KVR Degree College, Kurnool, where her husband resides. She paid Rs.7,000/- on 07-07-2010 to opposite party No.1 at the time of leaving the college, as opposite party No.1 insisted to pay, saying that she was not sanctioned RTF for the two years studied at opposite party No.1 college.  But the complainant’s husband found on internet that RTF of Rs.4,000/- each for 1st year and 2nd year was sanctioned on  behalf of her and adjusted to the college account on 06-03-2009 and 31-03-2010 respectively.  Inspite of repeated requests and a legal notice on 17-12-2010 for the refund of fee paid, no action was initiated by opposite parties.  But after a long time opposite party No.1 sent a calculation sheet and a cheque dated 11-12-2010 for Rs.5,500/- to the complainant, illegally deducting Rs.2,500/- in the name of arrears of fees.  Aggrieved by the attitude of the opposite parties this case is field by the complainant before this Forum seeking appropriate reliefs. 

 

3.     Sworn Affidavit and documents marked as Ex.A1 to Ex.A11 are filed by the complainant to support his case.

 

4.     In pursuance to the notice of this Forum opposite parties filed their written versions denying their liabilities to the complainant’s claim.   Opposite party No.1’s version in brief is that the complainant took her admission in B.Com (CA) agreeing to pay Rs.5,000/- every year.  She studied two years 2008 – 2009 and 2009 – 2010 in opposite party No.1  college and was due to pay fee a sum of Rs.10,000/-.  Opposite party No.2 sanctioned RTF of Rs.4,000/- per year to a total of Rs.8,000/- for two years.  Complainant paid (Rs.500/- and Rs.7,000/-) a total of Rs.7,500/- before the sanction of RTF, leaving Rs.2,500/- as fee out standing in her account.  Hence Rs.2,500/- fee arrear was deducted from Rs.8,000/- RTF sanctioned and the balance Rs.5,500/- was refunded to her by way of cheque dated 11-12-2011.  Higher authorities of Government also enquired on the complaint given by the complainant and gave a report stating that the allegation is false.  Further opposite party No.1 avered that the college lost Rs.5,000/- of 3rd year fees as she left the college in the middle of the course. 

 

Opposite party No.2 is the District B.C. Welfare Officer, Kurnool.  The version of opposite party No.2 is that he sanctioned RTF to the complainant for two years 2008 to 2010 for her study in opposite party No.1 College as noted below.

Opposite party No.2 submitted that the principal’s of concerned colleges should reimburse the fee already paid by the student as soon as RTF is sanctioned by the Government, displaying a sanctioned list of candidates on college notice board.  He also avered that immediately after receiving complaint from the complainant, he ordered Assistant B.C. Welfare Officer, Kurnool.  Rural (ABCWO) to enquire and submit a detailed report.  Accordingly ABCWO enquired with opposite party No.1 and reported that opposite party No.1 repaid Rs.5,500/- to the complainant through a cheque bearing No.915389 dated 11-12-2010 deducting fee due of Rs.2,500/- (Rs.10,000 - 7,500) out of Rs.8,000/- sanctioned for the two years 2008 to 2010.  Opposite party No.2 finally stated that the issue of RTF was settled and there is no illegal collection of fee from the student.

 

        Under the circumstances explained above opposite parties prayed for the dismissal of the case.

 

5.     Opposite parties field sworn affidavits and documents marked as Ex.B1 to B-16 to prove their case.

 

6.     The complainant and opposite parties filed their written arguments.

 

7.     Hence the points for consideration are:

 

  1. Whether the complainant made out any case against opposite parties to prove deficiency on their part?

 

  1. Whether the complainant is entitled for any reliefs?

 

  1. What is the quantum of compensation that can be granted?

 

8.      POINTS 1 and 2:- Admittedly the complainant studied B.Com (CA) in opposite party No.1 college under fee structure of Rs.5,000/- per year.  Ex.B1 is the college fee structure.  She paid Rs.5,000/- at the time of admission in the first year during 2008 -2009.  She belong to vadde community and is entitled for RTF scheme of Government of Andhra Pradesh.  She completed 2nd year in the same college during 2009 – 2010 and got herself transferred to KVR Government College Kurnool to study 3rd year during 2010 -2011.  At the time of leaving opposite party No.1 College, she paid Rs.7,000/- to opposite party No.1.  Ex.A1/ B6 receipt for the same.  Opposite party No.2 sanctioned RTF of Rs.4,000/- for 1st year during 2008 – 2009  on   27-02-2009 and again Rs.4,000/-  for 2nd year during 2009 – 2010 on 08-02-2010.  Ex.B3 and B9 are sanction letters from opposite party No.2.  The complainant prior her leaving opposite party No.1 college, opposite party No.2 sanctioned Rs.8,000/- for two years (2008 – 2010) on behalf of complainant towards RTF.  As per opposite party No.2 as soon as RTF is sanctioned, the concerned colleges should refund the fee already paid by the student, displaying a sanctioned list of candidates on the college notice board.  At the end of 2nd year after the adjustment of RTF only Rs.1,500/- fee is due from the complainant.  But opposite party No.1 collected Rs.7,000/- instead of actual due of Rs.1,500/- (Rs.10,000 – (500+8,000)) from the complainant, ignoring the instructions of opposite party No.2.  Therefore opposite party No.1 collected Rs.5,500/- (7,000-1,500) in excess of actual due.  The opposite party No.2 and the enquiry officer appointed by opposite party No.2 during the enquiry without passing any remark on the fee structure adopted by the college accepted the calculation sheet submitted by opposite party No.1 Ex.B1 is report.  Finally the excess collected amount of Rs.5,500/- was refunded to the complainant  in the form of cheque  No.915389 dated 11-12-2010 along with calculation sheet.   Ex.A2/B2 the Xerox copy of the cheque and Ex.A4 the calculation sheet.  In conclusion the complainant in order to get the refund of excess collected fee, was made approach higher officers of Government.  In view of what is stated above the Forum holds that the action of opposite party No.1 is not proper in deleing the issue, and the deficiency of service on the part of opposite party No.1 is sustained entitling the complainant for the reliefs.  No liability on opposite party No.2.

 

9.      Point No.3:- The refund of Rs.2,500/- does not arise because Rs.5,500/- fee which was collected in excess was already repaid to the complainant by opposite party No.1.  But for the negligence of opposite party No.1  in the verification of RTF orders from the Government and the mental agony caused by him to the complainant to get refund by approaching  higher officers, compensation of Rs.1,500/- is allowed. 

 

10.    In the result, the complaint is partly allowed directing the opposite party No.1 to pay compensation of Rs.1,500/- for his negligence and causing mental agony.  Rs.500/- is sanctioned as cost of the case.  Time for compliance is one month from the date of receipt of this order.  The case against opposite party No.2 is dismissed.

10.    In the result, the complaint is partly allowed directing the opposite party No.1 to pay compensation of Rs.1,500/- for his negligence and causing mental agony.  Rs.500/- is sanctioned as cost of the case.  Time for compliance is one month from the date of receipt of this order.  The case against opposite party No.2 is dismissed.
