Per Mr.B.A.Shaikh, Hon`ble Presiding Judicial Member.

 

          Appeal was taken up for hearing on 12.20 p.m. At that time none had appeared for appellant. It was therefore kept back.  Then it is again taken up now at 12.45 p.m. At this time also none appeared for appellant.  The perusal of previous daily proceedings shows that appellant`s advocate remained absent continuously from 17.10.2011 for four dates i.e. on 17.10.2011, 15.12.2011, 29.02.2011 & 23.04.2012. Today also none appeared for the appellant.  Hence we are satisfied that appellant is not interest in pursuing the appeal.  Therefore appeal is dismissed in default. No order as to cost.
