The complaint is allowed in part.

a) Should the complainant chose to pay the balance amount of Rs.50,000/- to the O.P, it would be incumbent upon her to complete the constructions of the apartment bearing No:N-3 in Devi Apartment Phase IV situated at Kotnoor-D village in all respect together with all basic amenities spelled out in the agreement of sale and also under the registered sale deed.

b) The complainant is required to deposit the said sum of Rs.50,000/.- in this Forum within a period of four weeks from the date of this order under due intimation to the O.P. The O.P on receipt of the information would be liable to complete the construction and provision of amenities within a period of 12 weeks and handover the physical possession to the complainant with due intimation to this Forum.

c) Subject to the satisfactory receipt of possession of the complainant, the Forum would release the amount of Rs.50,000/-, if deposited by the complainant to the O.P.

d) There would be no order as to costs, compensation or otherwise.

e) Office to provide free copies to the litigants.
