Learned counsel for the parties have filed IA/2, an application stating that the parties have settled their dispute in terms of a compromise outside Court. According to the compromise, in full satisfaction of the claim respondent no.1 / complainant does not want to continue the complaint and seeks to withdraw the same. This compromise application has been signed by the Branch Manager of Sahara India and also by Pushplata Soni, complainant / respondent no.1. In support of the averments made in the application an affidavit of complainant, Pushplata Soni has also been filed.
Learned counsel for the parties submit that this compromise has been entered into voluntarily by both the parties without any undue influence or coercion. Learned counsel for the respective parties have verified the signatures of the parties in the application.
In view of the submission made by learned counsel for the parties, we are satisfied that dispute involved in the matter has been resolved by the parties in terms of the compromise according to which the complainant has prayed for withdrawal of the complaint.
Accordingly, the compromise application is allowed and the appeal is disposed of in terms of the compromise presented by the parties.
