O R D E R
BY SRI RAVI SHANKAR, JUDICIAL MEMBER
Heard from respondent. Appellant is not present.
2. The learned advocate for respondent submits that, the complainant attempted to withdraw an amount of Rs.15,000/- on 19-3-2015 at about 1.13 p.m. The said transaction was not successful, the amount was reverted back. Subsequently at 1.15 p.m. the complainant made an another attempt for withdrawal of Rs.15,000/-, the said transaction was successful. But the complainant alleges he had not received any amount and he lodged a complaint before customer care. After receipt of the customer complaint, they have investigated the matter and also noticed to the log journal record where it was reflected that an amount of Rs.15,000/- was dispensed at 1.15 p.m. on 19.3.2015. The complainant filed a false complaint in order to gain wrongfully. There is no any deficiency in service.
3. After considering these facts, the District Commission dismissed the complaint. The complainant has not urged valid grounds to set aside the order passed by the District Commission, hence prays to dismiss the appeal also.
4. Appellant is not present after filing this appeal and not submitted any convincement argument to set aside the order passed by the District Commission. Anyhow, upon looking at the order passed by the District Commission and memorandum of appeal, documents produced, we noticed the transaction took place on 19-3-2015 at 1.15 p.m. for withdrawal of Rs.15,000/- was successful. Log journal record is an authenticated document which has to be looked into, when log journal discloses the amount was dispensed and transaction was successful, the allegations made by the complainant cannot be believable. Even the transaction slip produced by the complainant also discloses an amount of Rs.15,000/- was dispensed. When such being the case the allegations made by the complainant that he had not received any amount at 1.15 p.m. is not acceptable.
5. The District Commission after considering the document produced by both parties had dismissed the complaint. We do not find any irregularity in the order passed by the District Commission, at the same time, no valid grounds urged in the memorandum of appeal to set aside the order passed by the District Commission. Accordingly appeal is also dismissed
Send a copy of this order to both parties as well as concerned District Consumer Commission.
