Appellant, Respondent as well as their respective counsel are absent. The record reflects that the parties are absent since long. Therefore notice Returnable on 9/8/2011 was issued to them however, on last date, inadvertantly it is written in the ordersheet that no notice was issued. The office copy of the notice reflects that the notices to both the parties were issued on their correct address given in the appeal memo. Therefore, it will have to be presumed that the parties are served with notice. But they did not turn up. Hence the appeal is dismissed in default.

No order as to costs.
