ORDER NO. 12 DT. 03.03.10

          Mr. Alok Mukherjee, Ld. Advocate for the Appellants, and Mr. Barun Prasad, Ld. Advocate for the Respondent, are present.  Appellant files an application supported by an affidavit thereby praying for disposal of the present Appeal in terms of the application supported by an affidavit filed today.  We have heard both sides.  On perusal of the application in question we find that parties have amicably settled the dispute among themselves.  On perusal of materials on record we find that Respondent has already informed in writing about the amicable settlement.  If that be the position, we find no impediment in admitting and allowing the application supported by an affidavit filed today on behalf of the Appellants.  In the result, the Appeal stands disposed of in terms of the application supported by an affidavit filed today, which do form a part of the order.
