Sh. Dinesh Tomar, Advocate, holding brief of Sh. Nitin Kumar, Advocate, is present on behalf of the revisionists.
Sh. Tenzin Dave, Advocate is present on behalf of the opposite party.
This revision petition has been preferred by the revisionists against the order dated 23.01.2018 passed by the District Forum, Dehradun in consumer complaint No. 147 of 2017; Smt. Youdon Vs. The Head / Representative, Birla Sun Life Insurance Company Limited and another, whereby the District Forum has closed the opportunity of the revisionists of filing the written statement and proceeded the consumer complaint ex-parte against the revisionists.
Learned counsel appearing on behalf of the opposite party – complainant has stated that he has no objection in case the revision petition is allowed subject to payment of costs and revisionists are granted further time for filing the written statement to the consumer complaint filed by the opposite party – complainant before the District Forum.
In the light of order dated 10.02.2017 passed by the Hon’ble Apex Court in Civil Appeal Diary No. 2365 of 2017; Reliance General Insurance Co. Ltd. and another Vs. M/s Mampee Timbers and Hardwares Pvt. Ltd. and another as well as in the interest of justice, the revision petition is allowed and the order impugned dated 23.01.2018 passed by the District Forum is set aside and the revisionists are granted further time for filing the written statement subject to payment of costs of Rs. 2,500/- by the revisionists to the opposite party. The costs shall be paid by the revisionists to the opposite party before filing the written statement.
The learned counsel for the parties have apprised the Commission that now 10.08.2018 has been fixed in the consumer complaint before the District Forum. Therefore, the revisionists shall file the written statement before the District Forum on or before 10.08.2018, the date fixed in the consumer complaint.
