It is stated that parties are entered into settlement out of Court in terms whereof of post dated cheque already issued by the Respondent in favour of the Appellant.  It is stated that the said cheque is dated 25.06.2009.  In view of the said settlement this appeal is dismissed for non-prosecution.  We make it clear in case the cheque bounces or settlement otherwise fails the Appellant will at liberty to make appropriate prayer to the Appellate Forum for revival of the appeal.
