1.                  The instant case was filed by complainant U/S 12 of the C.P. Act, 1986

wherein the complainant has  prayed for direction upon the o.p. to make over possession of the schedule flat measuring 425 sq. ft. and to execute the deed of conveyance after receiving the balance amount together with compensation and damages to the tune of Rs. 5 lacs as the O.P. in spite of repeated requests has not been paying heed to the demand of the complainant.

 

2.                  Notice was served but it returned unclaimed. So the complaint is disposed of

ex parte.

 

3.         Upon pleadings of both parties two points arose for determination :

 

i)          Is there any deficiency in service on the part of the O.P.  ?

ii)                  Whether the complainant is  entitled to get any relief as prayed for ? 

 

DECISION  WITH   REASONS      :

 

4.      Both the points are  taken up together for consideration. It appears from the

complaint and the deed of agreement that the parties entered into an agreement for sale of flat as mentioned in the schedule measuring 425 sq. ft. on 14-12-2010 at a consideration price of Rs. 4,62,000/- out of which a sum of Rs. 3 lacs was paid to the O.P. on 14-12-2010.

 

 

 

5.      Perused the deed of agreement and the money receipts dated 14-12-2012 with

respect to Rs. 3 lacs.  The O.P. agreed to make over the flat within 24 months of the agreement. In spite of repeated reminders, the O.P. did not comply with the terms of the agreement. On the contrary, she was trying to sell it out to any 3rd party. Be that as it may in view of the unchallenged testimonies we are of the view that this is a fit case where the prayer of the complainant shall be allowed.          

 

      Hence,

                       

O     R     D      E      R      E        D

 

           

 

      That the C. C. Case No.132  of 2013 ( HDF 132  of 2013 )  be  allowed ex parte  with  costs  against  the O.P. 

 

      The O.P. be directed to make over the flat as mentioned in the schedule measuring 425 sq. ft. at holding no. Kali Prasad  Mukherjee Lane, P.S.  Bantra, District – Howrah, and to execute and register the deed of conveyance after receiving the balance amount from the complainant within 30 days from the date of this order.

     

      The o.p. do also pay a compensation of Rs. 30,000/- to the complainant for causing mental pain and agony.

 

      The complainant is  also entitled to a litigation cost of Rs. 2,000/- from the O.P.

 

      The complainant is  at liberty to put the decree into execution after expiry of the appeal period.

       

      Supply the copies of the order to the parties, as per rule.
