This revision petition has been filed by the revision petitioners/Opposite Parties No.1 & 2, against order dated 01.07.2019 passed by District Consumer Disputes Redressal Forum-I, UT, Chandigarh, vide which, they (Opposite Parties No.1 & 2) were proceeded against exparte.

            Notice of this revision petition was issued to the respondents/complainants.

            Today, Sh.Nitin Verma, Advocate has put in appearance on behalf of the respondents/complainants by filing his memorandum of appearance, which is taken on record.

            Counsel for the revision petitioners/Opposite Parties No.1 & 2 has submitted that Opposite Parties No.1 & 2 were not properly served, as such, wrongly proceeded against exparte by the Forum.

            Counsel for the respondents/complainants has submitted that he has no objection if the exparte order qua Opposite Parties No.1 & 2 is set aside.

            In view of above, this revision petition is allowed. Order, referred to above, is set aside to the extent ordering exparte proceeding against the revision petitioners/Opposite Parties No.1 & 2.

            The Forum is directed to give opportunity to Opposite Parties No.1 & 2 to file reply and evidence/affidavit.

            Parties are directed to appear before the Forum on the date fixed i.e. 01.10.2019.

            Order passed is subject to payment of Rs.2,500/- as cost. Let amount of cost be paid by revision petitioners/Opposite Parties No.1 & 2 to the respondents/complainants on the date fixed before the Forum.

            In view of above, the application filed by the revision petitioners/Opposite Parties No.1 & 2 alongwith revision petition for dispensing with filing of certified copy of impugned order dated 01.07.2019 stands infructuous.

            Certified copies of this order be sent to the parties, free of charge    

            Complete record of complaint file be sent back to the Forum concerned alongwith certified copy of this order, so as to reach there before the said date.        File be consigned to the Record Room after completion.
