Final Order / Judgement

          Heard the learned counsel appearing for the applicant. Mr. A. Mukharjee, learned counsel, has entered appearance on behalf of opposite party No. 2. None has appeared for the other opposite parties.

            In the instant application, the applicant has prayed for directing the opposite party No. 2 LICI Housing Finance Ltd. to produce the original documents of Exhibit, 1, 3, 4, 5 6 and 7 and for directing the opposite party No. 1 to produce the original document marked as Exhibit 2.

            Today, learned counsel appearing for the opposite party No. 2 has submitted the original documents of Exhibit Nos. 1,2 and 4.

            Since no objection has been raised by the opposite parties and the said documents are necessary for recording of evidence of the complainant, we direct the opposite party Nos. 1 and 2 to produce the original of the aforesaid documents on the date of cross-examination of witnesses to be examined by the complainant.

            Learned Commissioner  after marking the exhibited documents as proved in original, will return the original documents to the respective parties after recording of evidence.

            In case on the date of recording of evidence of the witnesses, the opposite parties fail to produce the original documents as directed, learned Commissioner will mark the secondary evidence exhibited by the witnesses as exhibits without insisting for the original.

            With the above order, Misc case is allowed and disposed of accordingly.
