ORDER

Heard Counsel for the Appellant.

The office has submitted report that the appeal has been filed with delay of 77 days.  The appellant has filed IA No.10165/24 for condoning the delay in filing the appeal.  In the IA, it has been mentioned that free certified copy of the Order has not been issued therefore delay has occurred. On coming to know about the order, the appellant applied for certified copy of the order which was issued on 18.06.2024 and the appeal was filed.  The Appeal has already been filed through E-filing on 01.06.2024 with the uncertified copy downloaded from internet.  The cause shown is sufficient.  Delay in filing the appeal is condoned.

By the impugned order, the appellant has been directed to refund the amount of Rs.2485810/- with interest @ 6% per annum if the refund is made till 15.02.2024, failing which the interest has been charged @ 9% per annum.  The Counsel for the appellant states that appellant is willing to comply the order in case the appellant be permitted to comply the order with interest @ 6% per annum in six equal monthly instalments.  In view of the statement of the Counsel for the appellant, the appeal is disposed of giving liberty to the appellant to comply the order of State Commission dated 15.02.2024 passed in CC No.2043/2017 in six equal monthly instalment with the interest @ 6% per annum.  The first instalment shall be paid till 01.09.2024 and the remaining instalment shall be paid till first date of every succeeding month till the final payment is made.  No coercive action shall be taken against the appellant in the execution application, if the appellant follows payment schedule as mentioned above.
