Today, learned counsel for the appellant, to whom the court notice was sent, has appeared and stated by inspite of sending notice to the appellant, the heirs of the appellant are not traceable.

Learned counsel Sh. Kishore Singh Pundir has appeared on behalf of respondent.

No substitution application has been submitted after the death of the appellant, so as to implead the legal heirs of the deceased / appellant and the statutory period of 90 days’ for moving the substitution application has already expired.

In such circumstances, there is no justification to continue the appeal. 

Accordingly, the appeal is hereby dismissed, as abated.  No order as to costs.

File be consigned to the record room along with copy of this order.

A copy of this order be sent to the concerned District Commission for perusal, information and necessary action.
